Indian Bar Association Serves Legal Notice Upon Dr. Soumya Swaminathan, the Chief Scientist, WHO

TrialSite Staff May 30, 2021

Dr. Soumya Swaminathan, the Chief Scientist at the World Health Organisation (WHO), was apparently served a legal notice by Indian Bar Association (IBA) on May 25, 2021, for her alleged act of spreading disinformation and thus misleading the people of India, in order to fulfill her own agenda, so the plaintiff’s action declares. It is reported that Dr. Soumya Swaminathan deliberately ignored and suppressed the FLCCC and BIRD Panel’s data regarding the effectiveness of the drug Ivermectin, with an intent to dissuade the people of India from using Ivermectin. Moreover, the nation of India has included ivermectin in their national protocol and, as TrialSite recently reported, in states where the treatment is in wide use an unprecedented reduction of cases is now reported. Of course, it’s difficult to prove a direct correlation without a designed study but the turnaround in cases in Uttar Pradesh, one of the states with a population-wide ivermectin regimen, is indeed striking.

According to entries in the Indian media, the notice is based on the research and clinical trials carried out by ‘Front Line COVID-19 Critical Care Alliance’ (FLCCC) and the British Ivermectin Recommendation Development (BIRD) Panel, who have presented enormous data that strengthen the case for the recommendation of Ivermectin in the prevention and treatment of COVID-19.

However, the Indian Council for Medical Research (ICMR) and All India Institute of Medical Sciences (AIIMS), Delhi have refused to accept her stand and have retained the recommendation for Ivermectin under ‘May Do’ category, for patients with mild symptoms and those in home isolation, as stated in ‘The National Guidelines for COVID-19 management’ last updated on May 17, 2021.

In order to stop Dr. Soumya Swaminathan from causing further damage to the life of citizens of this country, IBA has decided to initiate legal action against her and as part of the process, a legal notice has been served upon her.

WHO Misinformation Campaign ?

TrialSite has evidence that WHO is suppressing data as, recently reported, they issued a report on the significant local effort of the public health operation in Uttar Pradesh yet omitted a fundamental fact, that ivermectin is in fact in widespread use as part of the very initiative they reported on their website. Why would WHO go to such great lengths to suppress this important information, that is a treatment that’s actually working ? What kind of agenda has this organization adopted where it appears to use misinformation to deceive and disrupt nations seeking to get this pandemic under control ? Is this recent legal action in India merely a symbolic gesture or does it represent the harbinger of other such legal actions to come ?

Legal notice to WHO chief scientist for opposing Ivermectin’s use for Covid cure

Kashmir Times. Dated : 6/2/2021 10:00:29 AM

KT NEWS SERVICE

NEW DELHI, June 1 : A 51-page legal notice has been served on Geneva-based Dr Soumya Swaminathan, Chief Scientist of the World Health Organisation (WHO) by the Mumbai-based Indian Bar Association (IBA), a lawyers’ forum, for opposing use of Ivermectin for treating the patients of Covid-19.

It has threatened to prosecute her "under sections 302, 304 (II), 88, 120 (B) and 34 and other provisions of the Indian Penal Code (IPC) and under Disaster Management Act, 2005, in the appropriate Courts of Law having jurisdiction for each death caused due to your act of commission and omission."

The notice issued by IBA’s legal cell head Dipali N Ojha on May 25, having her office in Fort area of Mumbai, has taken exception to many statements of Dr Swaminathan, including her tweet on May 10 against use of the Ivermectin drug for Covid-19, except within clinical trials.

It says her tweet came soon after the announcement that day by Goa’s health minister to give the oral drub Ivermectin to the entire population of the state in a bid to bring down the mortality. The notice questions her for posting the tweet in her official capacity as the WHO’s chief scientist.

The notice says her statements in social media and mainstream media influenced the public against the use of the drug and amounted to an attack on the credibility of acclaimed bodies/institutes like ICMR (Indian Council of Medical Research) and AIIMS (All India Institute of Medical Sciences), Delhi that had included Ivermectin in the National Guidelines for Covid-19 Management.

The main grounds for suing her are : Falling standards of WHO and deprecating commendable work by select courageous medical doctors who have lived up to their Hippocratic oath. The notice questions her for providing in her tweet a link to a statement on the website of pharmaceutical company Merck, titled "Merck statement on Ivermectin use during Covid pandemic."

The notice also refers to her interview by noted TV journalist in her YouTube channel MOJO Story on May 16, in which she refers to the WHO’s "Living Guidelines" updated from time to time that say "evidence on Hydroxychloroquine, Lupinavir, Ritonavir, Interferon, Ivermectin , Remdesivir and all of these, does not support its use on a wide scale for people infected with SARS CoV-2."

It says Ivermectin is also recognised by WHO as one of the ten essential medications and around 3.7 billion of its doses have been given out in the last 40 years, with sufficient data to prove its safety. "You have wilfully ignored the mountains of data that shows that Ivermectin is undeniably helpful as prophylactic in preventing contracting COVID-19 and there is compelling evidence of its effectiveness in treating active COVID- 19 in hospitalized patients."

The notice also accuses Dr Swaminathan of ignoring "the research undertaken by several doctors, scientists and their associations and alliances, who had started early on the pandemic, fervently searching for medicine/drug that would help in treatment of COVID-19, and whose work which includes discussions, paper presentations, data on clinical trials, is readily available on the internet."

It has referred in this regard the US based FLCCC (Front Line COVID-19 Critical Care Alliance), an alliance of experienced and esteemed medical doctors and scientists, who have come together at the start of the COVID-19 pandemic and are working tirelessly in conducting research, studies and randomized control trials.

The notice includes testimonies of Dr Pierre Kory, MD, on behalf of FLCCC, in two Senate hearings in the United States on May 6, 2020 and on December 8, 2020 on recommendation of Corticosteroids to save lives of critically ill patients and justifying the use of Ivermectin as a wonder drug to treat the Covid-19 patients, urging the Senate to have a look at the FLCCC manuscript covering the results of 10 randomised control trials.

A detailed research done by the IBA also points out how a US judge ordered administration of Ivermectin to a critically ill and comatose female patient Nurije Fype (68) at Elmhurst Hospital in the United States that helped her dodge death due to inclusion of Ivermectin in her line of treatment.

India has charged WHO scientist Dr. Soumya Swaminathan with mass murder.

    https://www.logically.ai/factchecks…

    Shivika Sharma ; Sep 10, 2021 4:36:09 PM

The Indian Bar Association, a private voluntary organization of lawyers, has no jurisdiction to charge the scientist with murder.

Articles claiming that India has charged World Health Organization (WHO) scientist, Dr. Soumya Swaminathan, with mass murder are doing the rounds on social media.

In May 2021, an entity by the name of the Indian Bar Association (IBA) served a legal notice to Swaminathan for spreading "disinformation" about the effectiveness of ivermectin as a COVID-19 treatment. The entity alleges that ivermectin, an anti-parasitic, is effective in treating COVID-19. WHO doesn’t recommend ivermectin.

The Mumbai-based IBA has no statutory or regulatory status in India and should not be confused with the Bombay Bar Association, which is the official association of lawyers practicing in the Bombay High Court. Furthermore, it is important to note that sending a legal notice is not the same as charges being filed in a court of law.

IBA describes itself as “an association of lawyers who are united in the cause of bringing in transparency and accountability in Indian judiciary." In its 51-page long notice, IBA alleges that Dr. Swaminathan has “intentionally ignored” and “deliberately chosen” to ignore the research and findings of fellow doctors and physicians such as U.S.-based Front Line COVID-19 Critical Care Alliance (FLCCC) and the British Ivermectin Recommendation Development (BIRD) Panel, which claim that ivermectin is useful as a prophylactic and for treating COVID-19.

FLCCC has been notorious for promoting ivermectin as a treatment for COVID-19. It has falsely stated that ivermectin is “effectively a ‘miracle drug’” that could obliterate COVID-19 transmission and prevent illness, and an article written by its members was taken down from the peer-reviewed journal Frontiers in Pharmacology for making unsubstantiated claims.

There isn’t satisfactory evidence that ivermectin can prevent or treat COVID-19. As the Washington Post has stated, “it’s possible ivermectin has some clinical benefits in treating the coronavirus. It’s just that the data is highly inconclusive — and some of the most oft-cited studies in favor of the drug have holes in them."

In February, an ivermectin manufacturer, Merck, stated that the company’s research analysis identified that there is no scientific basis for a potential therapeutic effect against COVID-19 from pre-clinical studies and that there is a concerning lack of safety data in the majority of studies coming out in support of ivermectin.

Earlier in June, the Directorate General of Health Services under the Union Health Ministry in India updated its COVID-19 guidelines to exclude ivermectin from its recommended drugs for the treatment of COVID-19.

In its response to the legal notice against its senior scientist, a WHO spokesperson said that “WHO’s assessment of Ivermectin for treatment of COVID-19 is based on the current state of scientific evidence. WHO guidelines are developed by an independent global guidelines development group and are updated regularly when new data becomes available."

The COVID-19 pandemic has given rise to a lot of potentially dangerous misinformation. For reliable advice on COVID-19, including symptoms, prevention, and available treatment, please refer to the World Health Organization or your national healthcare authority.

  • Indian Bar Association serves legal notice upon Dr. Soumya Swaminathan, the Chief Scientist, WHO.

A legal notice is served by Indian Bar Association (IBA) upon Dr. Soumya Swaminathan, the Chief Scientist at the World Health Organisation (WHO) on May 25, 2021 for her act of spreading disinformation and misguiding the people of India, in order to fulfil her agenda.

The notice is based on the research and clinical trials carried out by ‘Front Line COVID-19 Critical Care Alliance’ (FLCCC) and the British Ivermectin Recommendation Development (BIRD) Panel, who have presented enormous data that strengthen the case for recommendation of Ivermectin in prevention and treatment of COVID-19.

Dr. Soumya Swaminathan has ignored these studies/reports and has deliberately suppressed the data regarding effectiveness of the drug Ivermectin, with an intent to dissuade the people of India from using Ivermectin.

IBA has observed that the content of several web links to news articles/reports included in the notice served upon Dr. Soumya Swaminathan on May 25, 2021, which was visible before issuing the notice, has either been removed or deleted now.

IBA had anticipated this and therefore, we have downloaded soft copies of these news articles before issuing the legal notice. It is ludicrous on part of the forces resorting to such cowardly acts, for they do not know that they are providing very strong evidence of their desperate attempt at blocking information/news regarding Ivermectin.
